***Go to the NY State Assembly//NY state consolidated laws site and look up the laws. Though i don;t know the actual name of thefingerprinting laws per se, (section article # etc) but i do know that in NY to fingerprint someone the agency must have authorization to fingerprint via NY state DCJS. If they do not have that authorization they cannot legally fingerprint someone.
A volunteer for a govt agency can be fingerprinted as long as the govt agency has a contract with the NY state DCJS or FBI to fingerprint someone then the person can be fingerprinted. NY state agencies can fingerprint people or even find out their criminal history without fingerprinting people because they are authorized to do it.
But if it is a private agency that has not obtained authorization via NY DCJS then they cannot fingerprint the person legally
